Online Store Regulations

These Regulations define the rules for using the Terra Tech Store online store, placing orders, concluding sales agreements, making payments, Product delivery, the right to withdraw from the contract, making complaints, and the rules of cooperation with the Seller.

Terra Tech Store – car parts, technical products and solutions for the automotive industry.

We offer new products, including car parts, replacements, and original products. We make every effort to ensure that the offered products are properly described, checked, and matched to the declared application.

§ 1. General provisions

1. The online store operating under the name Terra Tech Store is run by:

2. The store sells products through the Terra Tech Store online store.

3. The Regulations define the rules for using the Store and the rules for concluding and executing sales contracts between the Seller and the Customer.

4. The Regulations are made available to the Customer free of charge before the conclusion of the contract in a manner enabling their acquisition, reproduction, and retention.

§ 2. Definitions

The terms used in these Regulations mean:

  • Store – Terra Tech Store online store.
  • Seller – CHODURA INVESTMENTS Sp. z o.o.
  • Customer – a natural person, legal person or organizational unit making a purchase in the Store.
  • Consumer – a natural person performing a legal act with the Seller not directly related to their business or professional activity.
  • Entrepreneur with consumer rights – a natural person concluding a contract directly related to their business activity, if the content of this contract indicates that it is not of a professional nature for them.
  • Product – a movable item offered in the Store.
  • Order – a declaration of the Customer's will aimed at concluding a Product sales contract.
  • Sales Agreement – an agreement concluded between the Customer and the Seller through the Store.

§ 3. Products and product information

1. Products presented in the Store are shown along with information regarding their properties, parameters, application, and – in the case of car parts – compatibility, if such information is available.

2. Before purchasing a car part, the Customer should verify its compatibility with a specific vehicle.

3. In case of doubts concerning the Product's suitability, the Customer may contact the Seller before making a purchase.

4. Compatibility information included in the Product description is intended to facilitate the selection of the appropriate part; however, for products requiring individual adjustment, the Customer should perform additional verification.

5. Product photos presented in the Store are illustrative, unless the offer description states otherwise.

6. Products offered in the Store are generally new products, unless the offer clearly indicates a different condition of the Product.

§ 4. Product prices

1. Product prices presented in the Store are gross prices and include VAT, unless otherwise stated for the given Product.

2. The Product price stated at the time of placing the Order is binding for the Seller and the Customer.

3. In the event of a price reduction for a Product, the Seller also presents information on the lowest price of that Product applicable during the period required by applicable law.

4. Delivery costs and available payment methods are presented to the Customer before placing the Order.

§ 5. Placing orders

1. Orders can be placed through the online Store.

2. To place an Order, the Customer should:

  1. select the Product and its quantity,
  2. add the Product to the cart,
  3. provide the data necessary to fulfill the Order,
  4. choose the delivery method,
  5. choose an available payment method,
  6. accept the required terms and conditions,
  7. confirm the Order with a button indicating the obligation to pay.

3. Before placing an Order, the Customer receives information regarding the main features of the Product, its price, delivery costs, and available payment methods.

§ 6. Conclusion of the sales agreement

1. After placing an Order, the Customer receives a message confirming its receipt.

2. The sales agreement is concluded on the terms specified in applicable law.

3. Confirmation of the conclusion of the contract and information regarding the Order are provided to the Customer on a durable medium, especially via email.

§ 7. Payments

1. The Customer can use the payment methods available in the Store when placing an Order.

2. Available payment methods are presented to the Customer before placing the Order.

3. The Seller may provide various payment methods through payment operators cooperating with the Store.

4. The availability of individual payment methods may depend on the Order value, transaction type, or other conditions specified by the payment operator.

§ 8. Delivery

1. Product delivery is carried out through carriers and delivery methods available in the Store.

2. Currently, the primary delivery method is delivery via InPost, specifically to Paczkomaty (parcel lockers) and via courier, in accordance with the options available when placing the Order.

3. Products in stock are prepared for shipment as quickly as possible.

4. Orders placed by 3:30 PM are generally shipped on the same business day, if the Product is in stock and there are no obstacles independent of the Seller.

5. The estimated delivery time is presented to the Customer during the Order placement or in the information regarding the selected delivery method.

6. The Seller takes due care to ensure that the Products are properly secured for transport.

§ 9. Sales document and invoices

1. The Seller documents sales in accordance with applicable law.

2. A Customer who is an entrepreneur and wishes to receive an invoice for their company should provide correct company details and NIP (tax identification number) when placing the Order.

3. In the case of a Consumer who is a natural person not conducting business activity, an invoice may be issued without the buyer's NIP number.

4. If the Customer wishes to receive an invoice for their company, they should indicate this nature of the purchase when placing the Order and provide the Seller with the required data.

5. The Customer is responsible for the accuracy of the provided data necessary for issuing the sales document.

§ 10. Right of withdrawal from the contract

1. A Consumer who has concluded a distance contract generally has the right to withdraw from the contract within 14 days without giving any reason.

2. In the case of a single Product sales contract, the withdrawal period starts from the day on which the Consumer or a person designated by them, other than the carrier, took possession of the Product.

3. In other situations, the method of calculating the period is determined by applicable law.

4. To exercise the right to withdraw from the contract, the Consumer should inform the Seller of their decision before the expiry of the statutory period.

5. The Consumer may use the withdrawal form, but it is not obligatory.

7. The right to withdraw from the contract does not apply in cases specified in applicable law.

§ 11. Effects of withdrawal from the contract

1. In the event of effective withdrawal from the contract, the Seller shall refund the payments made by the Consumer in accordance with the principles specified in applicable law.

2. The Seller may withhold reimbursement of payments until receiving the returned Product or until the Consumer provides proof of its return, whichever occurs first.

3. The Consumer should return the Product immediately, no later than within the period resulting from applicable law.

4. The Consumer bears the direct costs of returning the Product, unless the obligation to bear them results from legal provisions or the Seller agreed to bear them.

5. The Consumer is liable for any diminished value of the Product resulting from its use beyond what is necessary to establish the nature, characteristics, and functioning of the Product.

§ 12. Complaints and non-conformity of goods with the contract

1. The Seller is liable to the Consumer for the conformity of the Product with the contract on the terms specified in applicable law.

2. In the event of non-conformity of the Product with the contract, the Consumer may file a complaint directly with the Seller.

3. Under the liability for non-conformity of goods with the contract, the Consumer may exercise the rights provided in applicable law, in particular demand repair or replacement of the Product.

4. In cases specified by law, the Consumer may also demand an appropriate price reduction or withdraw from the contract.

5. The Seller's liability for non-conformity of the Product with the contract lasts for the period specified by applicable law.

6. The Seller should respond to the Consumer's complaint within 14 days from the date of its receipt, if legal provisions provide for such a deadline.

7. If the Seller does not respond to the Consumer's complaint within the legally required period, the consequences provided for in applicable law shall apply.

9. In the complaint report, it is advisable to provide the Order number, Product name, description of the detected non-conformity, and contact details.

§ 13. Warranty

1. If a warranty has been granted for a given Product, information regarding the guarantor, warranty period, and terms of its fulfillment is provided to the Customer along with the Product or in the offer description.

2. The warranty, if granted, constitutes an independent basis for pursuing claims separate from the Seller's liability for non-conformity of goods with the contract.

3. Exercising the warranty does not exclude or limit the Consumer's rights arising from applicable provisions regarding non-conformity of goods with the contract.

§ 14. Product safety

1. Products offered in the Store should be used in accordance with their intended purpose, instructions, and safety information provided by the Seller or manufacturer.

2. For automotive products requiring specialized installation, it is recommended that installation be performed by a person with appropriate knowledge and experience.

3. The Customer should familiarize themselves with the information regarding safe use of the Product before beginning its use or installation.

4. Information regarding product safety, product identification, and required information can be found on the Product Safety / GPSR page and – depending on the Product – in its description or instructions.

§ 15. Personal data

1. Customer personal data is processed in accordance with applicable personal data protection regulations.

2. Detailed information regarding the processing of personal data can be found in the Privacy Policy.

§ 16. User reviews and content

1. If the Store allows Customers to post reviews or other content, the Customer should only post content that is legal, truthful, and related to the Product or service.

2. It is forbidden to post unlawful, offensive content, infringing on the personal rights of others or the rights of third parties.

§ 17. Sales to entrepreneurs and B2B cooperation

1. The Store sells to both Consumers and entrepreneurs.

2. An entrepreneur making a purchase for a company should provide correct company details and a tax identification number (NIP).

3. In the case of entrepreneurs, the scope of rights and liability may also arise from the applicable provisions of law regarding contracts concluded between entrepreneurs.

4. The Seller also enables individual negotiation of cooperation terms with workshops, automotive stores, companies and regular customers.

§ 18. Out-of-court complaint handling and claim enforcement methods

1. The Consumer may use available out-of-court methods for handling complaints and pursuing claims.

2. In particular, the Consumer may seek assistance from the locally competent consumer ombudsman or other competent institutions dealing with consumer rights protection.

3. Information on possibilities of obtaining consumer assistance is also available on the websites of the Office of Competition and Consumer Protection.

§ 19. Liability and use of the Store

1. The Customer is obliged to use the Store in a manner consistent with the law, the Regulations, and good customs.

2. It is forbidden to provide unlawful content through the Store.

3. The Seller takes action to ensure the proper functioning of the Store.

§ 20. Changes to the Regulations

1. The Seller may make changes to the Regulations for important reasons, in particular in the event of changes in legal provisions, changes in payment or delivery methods, changes in Store functionalities or the need to correct errors.

2. Changes to the Regulations do not affect the rights acquired by Customers in connection with Orders placed before the changes came into force.

3. In the event of changes to the Regulations, the Customer will be informed of the changes in the manner required by applicable legal provisions.

§ 21. Final provisions

1. For matters not regulated by these Regulations, the provisions of law applicable in the territory of the Republic of Poland shall apply.

2. The provisions of the Regulations are not intended to exclude, limit or infringe the rights of the Consumer resulting from absolutely binding legal provisions.

3. If any provision of the Regulations proves to be invalid or ineffective, the remaining provisions remain in force to the extent permitted by applicable regulations.

4. The Regulations are effective from August 1, 2026.

The Regulations constitute a document defining the rules for using the Store and concluding sales contracts. In case of discrepancies between the provisions of the Regulations and absolutely binding legal provisions, the relevant legal provisions shall apply.
